Terms of Service

Please read carefully the following terms governing the access and use of our services and products.

These Terms of Use ("Terms") govern the use of websites, software products (extensions), hosting and support services ("Services") provided by Custom Services LTD, based in England and Wales, and with a distinctive title in Greece "OpenCart Greece" (hereinafter "Company"). Access or use of our Services constitutes full and unconditional acceptance of these Terms.

1. General Terms

1.1. Acceptance of Terms: The use of any Service of the Company implies the full acceptance of these Terms. If you do not agree with the Terms, you must not use the Services.

1.2. Modification of Terms: The Company reserves the right to unilaterally modify these Terms at any time. Changes will be posted on this page indicating the date of last update. Continued use of the Services after the amendments constitutes acceptance of the new Terms.

1.3. Right to Refusal to Provide Services: The Company reserves the right to refuse the provision of services or the creation of an account to any natural or legal person, at its absolute discretion, without an obligation of justification.

1.4. Right to Interrupt or Cancel Services Provided: The Company reserves the right to discontinue or cancel any work or service provided, even if it is in progress, if any of the following reasons exists:

  • (a) lack of sufficient or proper consultation with the customer;
  • (b) a change in the subject matter of the work in relation to the originally agreed request or offer;
  • (c) actions or omissions of the customer that make difficult or impossible the smooth implementation of the project, including delays in providing access, content or approvals;
  • (d) the Company's decision, at its sole discretion, not to continue providing the service for any reason.

In any such case, the Company may discontinue work without further obligation. Reimbursement of amounts depends on the stage of implementation and the degree of delivery of the project, and any sums due for work already provided are immediately required.

2. User Data and Privacy

2.1. Data collection: When browsing our websites, registration or use of the Services, we collect data such as IP address, browser type, registration details (name, email, address, VAT etc.) and usage data. The data collection and processing shall be governed by the Privacy Policy and applicable GDPR legislation.

2.2. Data Usage: Data is used to provide and improve Services, Pricing, Customer Support and Communication. To monitor traffic, tools such as Google Analytics are used.

2.3. Data Security: We take appropriate technical and organisational measures to protect data. Sensitive information is protected by encryption.

2.4. Data Request: You can request a copy or deletion of your data through the platform billing.opencartgreece.gr or contacting us.

3. Extensions Terms of Use

3.1. Licenses

3.1.1. License Grant: Upon purchase of an extension, a non-exclusive, non-transferable license is granted for one (1) domain only (page), which is declared on purchase. Use in multiple domains requires buying a separate license for each domain.

3.1.2. Non-Transfer: Licences shall be registered and shall not be transferred, sold or assigned to third parties. If you have access to extension without being the licence holder, you must immediately purchase a new licence.

3.1.3. Activation & Validation: The activation takes place automatically within a few hours of the completion of the order. To validate the license, your server is required to communicate with the company's license server (https://license.opencartgreece.gr) over HTTPS (port 443). Failure to communicate will prevent the extension from working. Refer to License Activation Guide For details.

3.1.4. License Duration: The extension license is usually indefinite for basic functionality in the purchased version. However, access to updates and technical support is provided for a limited period (usually 1 year), as defined during purchase, and requires active assistance or renewal of authorisation.

3.2. Return Policy (Credit Balance)

3.2.1. Credit Request: The possibility of crediting the value of an extension to your account in eshop.opencartgreece.gr under the following conditions:

  • The request shall be submitted within 10 (10) calendar days from the date of purchase.
  • You have not downloaded the extension file from your account.
  • The request is accompanied by clear justification by email to [email protected] or via the platform billing.opencartgreece.gr.

3.2.2. Exceptions: Credit shall not be granted in cases of side-by-side purchase, incompatibility due to non-control of pre-market specifications, or if the file has been received. The Company reserves the right to refuse a credit claim at its discretion.

3.3. Extensions support

3.3.1. Support Area: Basic support shall be provided free of charge for the initial installation and confirmation of the proper operation of the extension, in accordance with its description, for the period covered by the active licence/support subscription.

3.3.2. Support Limitations: Support does not cover problems arising from modifications to the extension or OpenCart code, or problems with other third-party extensions, server problems, OpenCart upgrades or hosting environment changes. Such services are provided upon request and with the applicable workday charge. For more information on the available support packages, see Support Packages we offer for OpenCart.

3.3.3. Third Party Dependencies: For extensions based on third party services (e.g., bank APIs, Skroutz, Google), support covers only the operation of the extension itself. Changes by the third provider that affect the operation may require an extension upgrade, which may not be direct or free.

3.3.4. Support Requirements: To provide support, an active license/support subscription is required and the purchase has been made directly by the Company or authorised reseller with a valid license in the name of the end user.

3.3.5. Modification Systems: The user is responsible for the installation and proper operation of the required modification system (e.g., vQmod, OCMOD).

3.4. Purchase Process

3.4.1. Before Buying: The client must carefully read the description, functions and compatibility requirements (OpenCart, PHP, etc.) of the extension before purchase.

3.4.2. After Purchase: The extensions files are usually available for downloading from the client account in eshop.opencartgreece.gr after completion of payment. In some cases, confirmation or automatic dispatch may be required.

4. Hosting Services

4.1. Provision of Services: The Company provides hosting services (shared, managed, agency/white label) according to the characteristics of the packages described on the pages Hosting services and Hosting for Agencies.

4.2. Package Terms: The specific terms (resource limits, uptime, backups, support) for each hosting package are governed by the description of the package and the terms available on the management platform billing.opencartgreece.gr.

4.3. White Label Hosting: For White Label Hosting services, additional terms apply regarding branding, pricing and end customer support, as agreed with the partner (agency/developer).

4.4. Resource Usage: The customer must use the hosting resources according to the company's proper use policy.

4.5. Payment & Invoicing

4.5.1. Billing Cycles: Hosting services are charged on a monthly or annual basis, depending on the selected package. Invoices are issued automatically through the platform billing.opencartgreece.gr.

4.5.2. Payment Deadline: The invoices shall be payable within the date indicated. The customer is informed by email of the issue of each invoice.

4.5.3. Payment Methods: The available payment methods are indicated on the management platform. The Company reserves the right to modify available payment methods.

4.5.4. Late Payment: In case of non-prepayment, the terms of suspension described in Section 4.6 shall apply.

4.6. Suspension of Service due to Non-Payment

4.6.1. Suspension Conditions: If an invoice remains outstanding for 3-5 days after its expiry date, the Company is entitled to automatically suspend the hosting service without further notice, in addition to the initial notice for issuing the invoice.

4.6.2. Consequences of Suspension: During suspension:

  • The website becomes inaccessible to the public.
  • Email services are suspended.
  • The client has no access to the control panel or the hosting records.
  • Data remains stored but not accessible.

4.6.3. Service Reset: To restore the service after suspension, it is required:

  • (a) Full payment of the overdue amount, and
  • (b) Payment of a reactivation fee, which is stated on the Platform billing.opencartgreece.gr.

After payment, the service is usually reactivated within 24 hours.

4.6.4. Suspension Duration: If the service remains suspended for 30 days, the Company is entitled to make a final deletion in accordance with Section 4.7.

4.7. Permanent Deletion of Service

4.7.1. Timetable: If a hosting service remains suspended for thirty (30) calendar days, the Company is entitled to make a definitive and irreversible deletion of all service-related data.

4.7.2. Deletion Notice: The Company will send notice when the service is suspended, informing the client of the consequences of non-payment and the impending deletion in 30 days.

4.7.3. Delete Content: The definitive deletion shall include:

  • All website files (HTML, PHP, images, CSS, JavaScript, etc.)
  • All databases
  • All email accounts and their contents
  • All backups maintained by the Company
  • Any configuration or configuration related to the service

4.7.4. Customer Responsibility: The customer is solely responsible for creating and maintaining a backup of his data. The Company bears no responsibility for data loss resulting from final deletion due to non-payment.

4.7.5. Irreversibility: After final deletion, the data cannot be recovered. No refund is provided for services that have been deleted.

4.7.6. Rewrite: If the customer wishes to repeat the use of hosting services after final deletion, he should make a new order and configuration from the beginning.

5. Custom Extension Development Services

5.1. Scope of Work: The development of custom extension is based on the specifications agreed in writing (Project Agreement) between the Company and the client.

5.2. Copyright: Unless explicitly otherwise agreed in the Project Agreement, the Company retains the intellectual property of the code. The customer receives a license for this project. The possibility of full transfer of rights is provided by agreement and at additional cost.

5.3. Payment: An advance is usually required (e.g., 50%) to start and pay with delivery. For large projects, a partial payment plan may be agreed.

5.4. Warranty: A guarantee of good operation is provided for a specific period (e.g. 60 days) after delivery, covering errors (bugs) due to the code developed by the Company. The guarantee does not cover problems from external factors or subsequent changes.

6. Account Security

The user is solely responsible for maintaining the confidentiality of passwords in his accounts (eshop.opencartgreece.gr, billing.opencartgreece.gr) and for any activity resulting from them. Strong passwords are recommended. In case of suspicion of unauthorized use, the user must immediately inform the Company at [email protected].

7. Unacceptable Conduct

The Company does not tolerate any form of insulting, abusive, threatening, harassing or generally unacceptable behaviour towards its staff or associates. Such behaviour may lead, at the firm's absolute discretion, to an immediate termination of communication, refusal to provide support and/or permanent exclusion from all Services, without the right to refund money or credit.

8. Limitation of Liability & Disclaimer of Warranties

8.1. Disclaimer of Warranties: Services are provided "as they are" and "as available", without any explicit or implicit guarantee of any kind, including, for example, guarantees of commerciality, suitability for a specific purpose or non-infringement of third party rights, to the maximum extent permitted by law.

8.2. Limitation of Liability: In no case is the Company, directors, employees or associates responsible for any direct, indirect, random, special, incidental or punitive damage (including, for example, lost profits, data loss, termination of work) arising from or related to the use or inability to use the Services, even if the Company has been informed of the possibility of such damage. The Company's overall liability for any claim arising from these Terms will not exceed the amount paid by the user to the Company for the specified Services during the last six (6) months before the claim was raised.

9. Applicable Law & Jurisdiction

These Terms are governed and interpreted in accordance with the laws of England and Wales. For any dispute arising from or in relation to these Terms, the courts of England and Wales are exclusively responsible.
